Terms of service

These terms are an agreement between you and PendulumX LLC ("we", "us") for your use of Sellotics. By creating an account or using the service, you agree to them. If you use Sellotics for a business, you agree on behalf of that business.

Who can use Sellotics

• Sellotics is currently offered to sellers based in the United States.
• You must be at least 18, able to form a binding contract, and using the service for your business.
• Only connect shops and accounts you are authorized to connect.

The beta

Sellotics is in beta and open by invitation. Features may change, move between plans or be removed, and you may run into problems. Please don't share features that haven't been released yet.

The service

Sellotics uses data from your Etsy shop and the services you connect to show profit, costs, listing scores, suggestions and alerts, and offers tools to build and improve listings. It relies on platforms such as Etsy and Printify, whose availability and data we don't control.

Not financial, tax or accounting advice

Figures in Sellotics come from the data Etsy and your connections provide and the costs you enter, so they are only as complete as that data. They are business information, not tax, accounting or financial advice. Check important figures against your official statements and ask a professional about tax and accounting decisions.

Changes you send to Etsy

Nothing on Etsy changes unless you send a listing draft or turn on editing, review a change and confirm it. You are responsible for what you publish, including following Etsy's rules. We don't guarantee that Etsy will accept a listing or change.

Your account and team

• Keep your login secure. You are responsible for activity under your account, including by team members you invite.
• Give each team member only the access they need. You can change or remove it at any time.

Plans, trials and billing

• Paid plans and connection add-ons renew automatically each month or year until cancelled. Prices are shown before you subscribe. Payments are handled by Stripe.
• Each Etsy shop can have one free trial. A trial turns into a paid plan on the date shown when you start it unless you cancel before then. We email you 3 days before the first charge.
• Founding member prices stay in place for as long as you stay subscribed, including when you move between plans or add a connection.
• You can cancel at any time. Your plan continues until the end of the period you paid for, and your account then moves to Free. Your data stays.
• Fees are not refundable, except where the law requires a refund.
• We may change prices with at least 30 days' notice before your next renewal.

Acceptable use

Don't misuse the service, including by:

• accessing other people's data or accounts, or trying to get around security or plan limits;
• uploading unlawful content or content you have no right to use;
• using the service to scrape, overload or interfere with Etsy, Printify or our systems;
• reselling the service without our written permission.

Your data

You own your data. You give us permission to use it only to provide and improve the service, as described in our Privacy policy. You can export it and delete it at any time.

Third-party platforms

The term 'Etsy' is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc. Printify is a trademark of its owner and is not affiliated with us.

Changes and availability

We work to keep the service available but don't guarantee it will be uninterrupted or error free. We may change or discontinue features, and will give reasonable notice of significant changes. We may update these terms; we'll post the new version here and email you about significant changes before they take effect.

Disclaimers and limitation of liability

The service is provided "as is". Profit figures, listing grades, suggestions and tips are information to help you run your shop; they don't guarantee sales, search placement or any other result on Etsy. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim.

You agree to cover claims against us that arise from your listings, your shop or your breach of these terms, to the extent the law allows.

Ending these terms

You can stop using the service and delete your account at any time. We may suspend or close accounts that break these terms, and will tell you why unless the law or security prevents it.

Governing law

These terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Utah, and you and we agree to their jurisdiction.
